PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING OR USING THE INSUREPAY PLATFORM.

These Terms and Conditions (“Terms”) constitute a legally binding electronic contract under the Information Technology Act, 2000, the rules made thereunder, and all applicable amendments. By accessing, registering on, or using the GoInsure platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Platform.

1. INTRODUCTION

1.1 About the Company

Saral E-Commerce Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at B-49 Kanpur Road Yojna, Neelam Heights, Near Phoenix United Mall, Kanpur Road, Lucknow - 226012, Uttar Pradesh, India (hereinafter referred to as "GoInsure", "Company", "we", "us", or "our"), owns and operates the GoInsure platform.

1.2 About GoInsure

GoInsure is a B2B digital platform that enables registered merchants to facilitate insurance premium payments for end customers through BBPS (Bharat Bill Payment System) and/or authorised banking and payment partners.
  • Does not provide insurance
  • Does not underwrite risk
  • Does not act as an insurance intermediary, agent, broker, or advisor
  • Does not influence pricing, coverage, or policy terms

2. SCOPE OF SERVICES

2.1 Services Offered

GoInsure enables registered merchants (“Merchants”) to:
  • Collect insurance premium payments from customers
  • Route such payments through BBPS or authorised payment systems
  • Provide transaction confirmation and payment acknowledgements

2.2 Role Limitation

GoInsure acts solely as a technology and payment facilitation platform. All insurance policies are issued, serviced, and governed exclusively by the respective insurance companies.

3. DEFINITIONS

3.1 Applicable Law

All laws, rules, regulations, RBI / NPCI / BBPS circulars applicable in India • BBPS: Bharat Bill Payment System operated by NPCI

3.3 Customer

End consumer paying insurance premium

3.4 Merchant

Business entity authorised to use GoInsure

3.5 Transaction

Payment of insurance premium initiated via GoInsure

3.6 Service Provider

Insurance companies, banks, BBPS units, payment partners • Service Provider: Insurance companies, banks, BBPS units, payment partners

4. ELIGIBILITY & MERCHANT ONBOARDING

4.1 Eligibility

Only legally registered entities are eligible to onboard as Merchants.

4.2 Merchant Onboarding

Merchants must complete KYC, KYB, and due diligence as required by GoInsure, banks, BBPS, or regulators.

4.3 Merchant Obligations

Merchants shall:
  • Use GoInsure only for lawful insurance premium collections
  • Display accurate policy and insurer information to customers
  • Not misrepresent themselves as insurers or insurance advisors
  • Comply with IRDAI, RBI, BBPS, and NPCI guidelines
  • Resolve customer disputes promptly and professionally

5. PAYMENT FLOW & SETTLEMENT

5.1 Payment Flow

All payments are processed through BBPS or authorised payment partners.

5.2 Settlement

GoInsure may temporarily receive, hold, and route funds solely for settlement purposes.

5.3 Settlement Timelines

Settlement timelines are subject to BBPS rules, banking holidays, and system availability.

5.4 Liability

GoInsure is not liable for delays caused by insurers, banks, BBPS, or force majeure events.

6. LIMITATION OF LIABILITY

6.1 Liability

To the maximum extent permitted by law:
  • GoInsure shall not be liable for insurance coverage disputes
  • GoInsure shall not be liable for insurer service failures
  • GoInsure’s total liability shall not exceed the transaction facilitation fee earned for the disputed transaction

7. DISCLAIMER OF WARRANTIES

The Platform is provided “as is” and “as available”. GoInsure does not warrant:
  • Continuous availability
  • Error-free transactions
  • Insurer responsiveness or policy issuance

10. DATA PROTECTION & PRIVACY

10.1 GoInsure complies with the IT Act, 2000 and applicable data protection laws.

10.2 Data Protection

Merchant and customer data may be shared with:
  • BBPS
  • Banks
  • Insurers
  • Regulatory authorities
strictly for lawful and operational purposes.

11. CONFIDENTIALITY

Merchants shall maintain confidentiality of:
  • Platform access credentials
  • Transaction data
  • Commercial terms
  • System architecture

12. TERMINATION

12.1 Termination

GoInsure may terminate Merchant access:
  • With 15 days’ notice, or
  • Immediately in case of fraud, regulatory breach, or misuse

12.2 Upon Termination

Access shall cease immediately

12.3 Pending Liabilities

Pending liabilities shall survive

13. INDEMNITY

Merchant agrees to indemnify GoInsure against:
  • Regulatory penalties
  • Customer claims
  • Fraud, misrepresentation, or misuse
  • Breach of Applicable Law

14. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India. Courts at Lucknow, Uttar Pradesh shall have exclusive jurisdiction.

15. AMENDMENTS

GoInsure may modify these Terms at any time. Continued usage constitutes acceptance of updated Terms.

By using GoInsure, you confirm that you have read, understood, and agreed to these Terms.
